Petitions for Parents, Children, and Brother and Sister.

Petitions for Parents

Process: To petition for your parents (mother or father) to live in the United States as Green Card holders, you must be a U.S. citizen and at least 21 years old. Green Card holders (permanent residents) may not petition to bring parents to live permanently in the United States.

FAQ—Parent’s Petition:

(1) How many I-130 petitions do I need to file for my father and mother?

Since a parent is considered an immediate relative(IR), you need to file an I-130 petition for each of your parents. Thus, you need to file one I-130 for your mother and one I-130 petition for your father.

(2) My brothers and sisters are under 21 years of age. Can they come to the US as green card holders with my parents?

Since there are no derivative benefits available under an immediate relative (IR) petition, your brother and sisters cannot get immigrant visas with your parents, even though they are under 21. You need to file an I-130 petition for each of your siblings. However, immediately after your parent enters the US as a green card holder, he or she can file an I-130 petition for your unmarried brothers and sisters. Your parent does not need to wait for his or her green card. Instead, he or she can use the immigrant visa page and passport to file an I-130 petition.

Petitions for Brothers and Sisters ( Siblings )

Are you eligible? To petition to bring your sibling (brother or sister) to live in the United States as a Green Card holder, you must be a U.S. citizen and at least 21 years of age.

FAQ — Sibling’s Petition

(1) Can I file a petition for my brothers and sisters to bring them to live in the US permanently if I am a Permanent Resident?

No. Permanent residents may not petition to bring siblings to live permanently in the United States.

(2) How many I-130 petitions do I need to file for my brothers and sisters?

You need to file one I-130 petition for each of your brothers and sisters. However, you cannot file a petition for your siblings’ family members. Instead, you need to include them on the petition.
