What is a Waiver?

What Types of Waiver are Available?

There are several types of immigration waivers available under U.S. immigration law to address various grounds of inadmissibility and other immigration-related issues. Here are some common types of immigration waivers:

  1. I-601 Waiver (Waiver of Grounds of Inadmissibility) /  Hardship Waiver: This waiver is used to overcome a range of inadmissibility grounds, including unlawful presence, criminal history, fraud or misrepresentation, and certain health-related issues.  This waiver is used for misrepresentation or fraud under INA 212(a)(6)(i) ( 212(a)(6)(i) waiver )
  2. I-601A Provisional Unlawful Presence Waiver: This waiver is specifically designed for undocumented immigrants who are immediate relatives of U.S. citizens. It allows them to apply for a waiver of unlawful presence while they are still in the United States before departing for their consular visa interviews. This is also called  212 (a)(9)(B) waiver 
  3. I-212 Waiver (Permission to Reapply for Admission): This waiver is for individuals who have been previously removed from the United States and are seeking permission to reapply for admission after a period of ineligibility. This waiver is covered under INA 212(a)(9)(A) or 212(a)(9)(C).
  4. 212(h) Waiver (Waiver of Criminal Grounds of Inadmissibility): This waiver is available for certain criminal convictions and allows individuals to seek admission or adjustment of status despite having committed specific crimes. This waiver is covered under INA 212(h).
  5. 212(d)(3) Waiver (Nonimmigrant Waiver): This waiver allows individuals to overcome specific grounds of inadmissibility temporarily for nonimmigrant visa purposes. This waiver is covered under INA Section 212(d)(3)
